1. Acceptance of Terms
By accessing or using ThumbSketch AI at https://www.thumbsketch.ai (the "Services"), you agree to these Terms of Service. If you do not agree, do not use the Services.
2. Accounts
You may create an account using email/password or Google sign-in. You are responsible for your account security and all activities under it.
3. Subscriptions
We offer a free limited plan and a Premium subscription at $9 USD per month (recurring via Stripe). Subscriptions auto-renew monthly until canceled. You can cancel anytime by contacting [email protected]. No refunds for partial months unless required by law.
4. User Content
You retain ownership of content you upload or create (sketches, prompts, generated thumbnails). You grant us a limited license to process it to provide the Services. AI-generated thumbnails are created using third-party AI services (OpenAI). Ownership of outputs is subject to OpenAI's terms. You may not upload infringing or illegal content.
5. Intellectual Property
Our content, logo, design, and trademarks are owned by ThumbSketch AI. You may not copy or use them without permission.
6. Feedback
Any feedback or suggestions you provide may be used by us without compensation or credit.
7. Limitation of Liability
Our total liability is limited to the amount you paid in the last 6 months (or $0 if none). We are not liable for indirect, consequential, or punitive damages.
8. Dispute Resolution
Disputes will first be resolved through informal negotiations. If unresolved within 30 days, they will be resolved by binding arbitration in San Bernardino County, California, under AAA rules.
9. Governing Law
These Terms are governed by the laws of the State of California, United States.
10. Changes to Terms
We may update these Terms. Material changes will be notified by email or website notice.
