1. Acceptance of Terms
By accessing or using ThumbSketch AI at https://www.thumbsketch.ai (the "Services"), you agree to these Terms of Service. If you do not agree, do not use the Services.
2. Accounts
You may create an account using email/password or Google sign-in. You are responsible for your account security and all activities under it.
3. Subscriptions
A free account includes 3 starter credits, one time. No credit card is required for the free account.
Paid plans are Founding at $12 USD per month for 75 credits per billing period, and Pro at $19 USD per month for 100 credits per billing period. Limited to 50 Founding spots.
Your Founding price stays at $12 per month as long as your subscription stays active. If you cancel and your subscription ends, a new subscription is at the current Pro price.
Subscriptions renew each month until you cancel.
If you cancel from Manage subscription, access and any remaining paid credits continue until the end of the current billing period. We do not provide a partial-month refund unless the law requires one.
One credit is used for each generation, regeneration, or retry. Paid credits renew each billing period and do not roll over. A credit used for a failed generation is refunded automatically. Credits have no cash value.
Payments are processed by Stripe. We do not store your card number.
4. User Content
You retain ownership of content you upload or create (sketches, prompts, generated thumbnails). You grant us a limited license to process it to provide the Services. AI-generated thumbnails are created using Google (Gemini API). You may not upload infringing or illegal content.
5. Intellectual Property
Our content, logo, design, and trademarks are owned by ThumbSketch AI. You may not copy or use them without permission.
6. Feedback
Any feedback or suggestions you provide may be used by us without compensation or credit.
7. Limitation of Liability
Our total liability is limited to the amount you paid in the last 6 months (or $0 if none). We are not liable for indirect, consequential, or punitive damages.
8. Dispute Resolution
Disputes will first be resolved through informal negotiations. If unresolved within 30 days, they will be resolved by binding arbitration in San Bernardino County, California, under AAA rules.
9. Governing Law
These Terms are governed by the laws of the State of California, United States.
10. Changes to Terms
We may update these Terms. Material changes will be notified by email or website notice.
